How much does a divorce cost?

The cost of filing for divorce is regulated by law. The basic fee is 600 PLN for filing the divorce petition, which is borne by the party initiating the case. How much does a divorce cost without determining fault? In such cases, when the proceedings go smoothly, the court refunds 300 PLN to the plaintiff after the trial is concluded. The court then obliges the defendant to reimburse the plaintiff 150 PLN for costs. This type of divorce is generally less expensive and less complicated, encouraging both parties to reach an agreement.

If the division of property is required during the trial, additional fees will apply, depending on the level of agreement between the parties. When the parties agree on the division of property, the fee is 300 PLN. However, if there is no agreement and the court has to divide the property on its own, the fee is 1000 PLN. This process can further complicate and prolong the divorce, generating higher financial and emotional costs.

It is also worth noting that the attorney’s fee, which is an additional cost, is also charged by the divorce attorney. The pricing is determined individually by the law firm. There is an option to file a petition along with a request to be exempted from court fees, either fully or partially. In such a case, it is necessary to submit a statement regarding the financial and family situation, so that the court can assess the justification for the exemption from fees. The exemption from costs can cover not only court fees but also the attorney’s fees, which can significantly relieve the financial burden of the plaintiff.


What additional costs may be included in the cost of a divorce?

The divorce process may be associated with many additional fees beyond basic court fees and attorney’s fees. Some of them include:

  • mediator fees – for non-property matters, mediation fees are 150 PLN for the first meeting, and 100 PLN for each subsequent meeting. However, the total mediation fees should not exceed 450 PLN,
  • fee for an appeal – in precautionary proceedings, an additional fee for an appeal may apply, which amounts to 30 PLN,
  • court-appointed guardian fees – if the court orders a social investigation by a guardian, the cost of such an investigation is 81.28 PLN. If the guardian supervises parent-child meetings, the cost is 203.20 PLN per meeting,
  • appeal proceedings fees – depending on the type of appeal, the costs can vary significantly. For example, an appeal for joint use of the apartment costs 100 PLN, eviction appeal 200 PLN, property division appeal 1000 PLN, and child custody appeal 600 PLN,
  • fee for the justification of the verdict – if a party wishes to obtain the justification of a verdict, they must pay a fee of 100 PLN,
  • fee for returning to the pre-marriage surname – this involves a stamp duty fee, which amounts to 11 PLN.

Divorce costs can be significantly higher than initially anticipated, as they include not only the basic court fees and attorney’s fees but also a range of additional expenses.
